Welcome to GymBoards! GeoBoards, LLC ("we," "us," or "our") provides a gamified social fitness platform via the GymBoards mobile application ("GymBoards", "App"), website, and related services (collectively, the "Service"). Our goal is to connect a community of fitness enthusiasts who wish to share their achievements and track their progress.

1. Acceptance of Terms

By creating an account, Browse content, or otherwise using our Service, you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Service.

You affirm that you are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. This Service is not intended for individuals under the age of 18.

2. Health Warning and Assumption of Risk

This section is critical. Please read it carefully before using the Service.

  • The Nature of the App: GymBoards is a platform that allows users to upload videos of physical activities, such as weightlifting or gymnastic movements, to establish a "Record" on a public leaderboard. These "Records" are entirely generated by other users and are not created, endorsed, or vetted for safety by GeoBoards, LLC.

  • Activities are Inherently Dangerous: You understand and acknowledge that physical fitness activities, including those depicted in User Content on the App, are inherently risky and dangerous. These activities carry the potential for serious injury, disability, or even death.

  • No Professional Advice: GeoBoards, LLC is not a health or fitness advisor. The Service is for entertainment and informational purposes only. The content shared by users does not constitute medical or professional fitness advice. You should always consult with a qualified physician or physical therapist before beginning any new fitness regimen or attempting any activity you see on the App.

  • ASSUMPTION OF RISK: You voluntarily and expressly assume all risks associated with your use of the Service. This includes any risk of injury, damage, or loss you may suffer as a result of viewing, attempting, or recreating any "Record" or other activity posted by any user on the App.

  • RELEASE OF LIABILITY: To the fullest extent permitted by law, you hereby release GeoBoards, LLC and its officers, directors, employees, and agents from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with your use of the Service, including any and all injuries, damages, or losses you may sustain. You agree that this release is binding upon you, your heirs, assigns, and legal representatives.

3. User Content and Conduct

You are the owner of and are solely responsible for the photos, videos, comments, and other materials you post on the Service ("User Content").

The User Content section from your competitor's terms is well-written and serves as a strong foundation. It works very well for GymBoards because it places full responsibility on the user for what they post. I have adapted it below for your App:

By posting User Content, you agree that you will not post content that:

  • Is unlawful, libelous, defamatory, obscene, pornographic, harassing, threatening, abusive, inflammatory, or fraudulent.

  • Constitutes, encourages, or provides instructions for a criminal offense, violates the rights of any party, or that would otherwise create liability or violate any local, state, national, or international law.

  • Encourages reckless or excessively dangerous behavior that could foreseeably lead to injury.

  • Infringes on any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party.

  • Contains any unsolicited promotions, political campaigning, advertising, or solicitations (spam).

  • Contains private information of any third party without their explicit consent.

  • Contains viruses, corrupted data, or other harmful, disruptive, or destructive files.

While we are not obligated to do so, GeoBoards, LLC reserves the right to screen, edit, or remove any User Content at any time and for any reason without notice. We take no responsibility and assume no liability for any User Content posted, stored, or uploaded by you or any third party, or for any loss or damage thereto.

4. Modifications to the Terms of Use

We reserve the right to update or modify these Terms at our sole discretion. We will provide notice of significant amendments by posting the changes within the Service or through other direct communication. Your continued use of the Service after such changes have been posted constitutes your binding acceptance of the revised Terms.

5. User Accounts and Security

You are responsible for providing accurate and complete information when creating your account and for safeguarding your password. You are solely responsible for all activities that occur under your account. You must notify us immediately of any breach of security or unauthorized use of your account.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of GeoBoards, LLC and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.

7. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk.

GEOBOARDS, LLC, ITS AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT: a) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; b) ANY ERRORS OR DEFECTS WILL BE CORRECTED; c) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR d) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

IN NO EVENT SHALL GEOBOARDS, LLC, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

THIS LIMITATION OF LIABILITY IS COMPREHENSIVE AND EXPRESSLY INCLUDES ANY AND ALL CLAIMS FOR PERSONAL INJURY, DISABILITY, OR DEATH ARISING FROM YOUR PARTICIPATION IN ANY ACTIVITIES VIEWED ON THE SERVICE.

8. Indemnity

You agree to defend, indemnify, and hold harmless GeoBoards, LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage or injury to a third party.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Cook County, Illinois to resolve any dispute or claim arising from these Terms.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GeoBoards, LLC concerning the Service.
